Some principle aspects to adhere to when forming a Shar'i Waqf are as follows: The Waqf must be perpetual and directed to an avenue that generally does not end. eg. The poor or destitute. Thus even though the Waqf is made for the benefit of one's progeny it should be finally directed to a generally continuing avenue. Once the Waqf is executed, it no longer remains one's property and hence cannot be sold. The Waqf must be absolute and not contingent on the occurrence of an event. The above are some broad guidelines with regards to a Waqf. Specific issues could be referred to our offices for further clarification.
