Q: Is a verbal bequest effective from a Shari’ah perspective?

A: A verbal bequest is valid in terms of Shari’ah. It is not a requirement for it to be in writing. However, it is advisable to place the verbal utterance on record on a bonafide document and attach it to one’s will to avoid potential confusion or conflict. It is also safest and best to have witnesses to a verbal bequest.
